News: 'We still own Duke Nukem trademark,' says 3D Realms

Ownership of the trademark was never part of the asset purchase agreement with Gearbox.

Back in February Gearbox filed a lawsuit which stated: "Recently-and without consulting the Duke IP's actual owner, Gearbox- Interceptor announced its intent to develop a Duke Nukem game based upon the various characters, content and intellectual property owned by Gearbox; the proposed game is entitled 'Duke Nukem: Mass Destruction'."

Gearbox seeks damages for the misuse of the IP, requesting for an "amount to be proven at trial".

However, 3D Realms states that the Asset Purchase Agreement with Gearbox for Duke Nukem Forever gave 3D Realms the rights to complete and...

People mocked South Park: The Stick of Truth for being announced in 2011 and only released this month, but Dead State was announced in 2010 and still isnt finished. Duke Nukem creator gets bought out - but Apogee Software LLC remains unaffected.

Apogee Software LLC, however, a company formed in 2008 by Apogee Software Ltd. co-founders Scott Miller and George Broussard, has not been acquired by Interceptor.

The acquisition comes amidst a legal battle involving both Interceptor and 3D Realms who are accused of using the Duke Nukem license unlawfully by IP owner Gearbox in upcoming PS4/PC title Duke Nukem: Mass Destruction.

Gearbox acquired the IP during Duke Nukem Forever's development in 2010 and, judging by the legal proceedings, is not believed to have given Interceptor or 3D Realms permission to develop and...
